United Airlines has asked a federal court to dismiss a class-action lawsuit filed by passengers who claimed that window seats they paid extra for turned out to have no actual window or outside view. The complaint alleges that on certain Boeing 737, 757, and Airbus A321 aircraft, some seats located in the “window” position do not feature a real window — and that this was not disclosed during booking.
United argues that the term “window seat” merely refers to a seat positioned next to the aircraft’s fuselage and does not guarantee an exterior view.
Plaintiffs, however, say that passengers’ reasonable expectations were not met and that they would not have paid additional fees had they known the seats lacked windows. The lawsuits against United and Delta could potentially impact more than 1 million passengers per airline, involving claims for millions of dollars in damages.
